TERMS:

1%-10 Days, Net 30. Interest charge of 1.5% per month will be charged on any balance past due.

PRICES:

Prices are subject to change without notice unless stipulated in writing by PMC in its sales quote. Prices issued by formal quotation from PMC are firm for 30 days from the date of the quotation, providing all manufacturing and shipments are completed no more than 60 days from date of the quotation. Manufacturing and shipping of an order that is delayed at the request of a customer may be price-escalated to reflect current costs. Prices are subject to renegotiation if any quantity, accessory, option, or other condition is changed from the original quotation. Prices do not include lamps unless specifically stipulated. Any tax or other government charges shall be added to the price. All Orders received by PMC Lighting are contingent on the company’s acceptance of the order.

MINIMUM BILLING:

The minimum charge for factory orders is $250. The minimum charge for non-manufactured parts is $50. (plus shipping)

FREIGHT ALLOWANCE:

All shipments are FOB PMC Lighting, Warwick, RI, with the exception of the following: All factory shipments having a total price of $5000 (net of freight, taxes and overage) or more, for one consignee and for one release within the 48 contiguous states (excluding Alaska and Hawaii) qualify for freight allowed. Shipments must not include any special handling, packaging, pallets and/or truck requirements. Additionally, a surcharge will be invoiced for all shipments requiring a union driver. To satisfy the company’s freight allowance policy, a sales quote may only include one (1) shipment and one (1) release. Multiple shipments and releases on a sales quote do not qualify for the company’s freight allowance regardless of the net amount of the order. Lastly, if the customer specifies freight instructions that result in additional costs, the customer assumes all extra costs.

SHIPMENTS:

All orders are FOB PMC Lighting, Warwick, RI. PMC’s liability (shipping) ends with the acceptance of our product by the carrier at our loading dock. The consignee must make claims for damage and/or shortages to the carrier within 48 hours of delivery and not to PMC Lighting.

SAMPLES:

All samples are $500.00 plus freight FOB PMC Lighting, Warwick, RI. Samples must be returned within 90 days for full credit. Credit will be issued for sample upon inspection at factory less freight charges.

RETURNED MERCHANDISE:

No merchandise may be returned without prior written authorization from our factory. Request must be made in writing within 30 days from the day of shipment. Transportation must be pre-paid on all return merchandise. All non-stock, special, custom-made or modified versions of normal factory stocking items are not returnable. For those items that are authorized to be returned a credit will be issued at prices in effect at the time of the shipment, or at the time of return, whichever is lower, provided the products are in a saleable condition. A minimum of 25% restocking fee plus all freight costs incurred by the factory will be deducted from the credit to cover the costs of handling and inspection.

DELIVERY:

Estimated delivery dates are based on normal working conditions and vendor delivery estimates. All delivery dates whether affected by fires, strikes, acts of God, or all other unpredictable causes are subject to change. Under these or any other circumstances PMC will not accept any penalty charges levied against it, or recognize the validity of penalty clauses incorporated into sales contracts, written or verbal.

CANCELLATION CHARGES:

When orders are cancelled before production has begun customers will be charged a 25 % cancellation fee. Orders that are cancelled by the customer that are in production will be charged for all material, labor and overhead incurred as of the date of cancellation plus a 15 % cancellation fee. If any order is cancelled after shipment or if delivery is refused at destination, the customer is responsible for the total purchase of the order plus all warehousing and transportation costs incurred as a result of the cancellation.

CLAIMS:

PMC assumes no responsibility for the improper or wrong selection or installation of its products, or for labor costs involved in repair or replacement of these fixtures. The company’s liability is limited to replacement of defective parts and only when authorization by the company. The company shall, at its expense, rework, repair or replace the defective parts or fixtures. PMC shall not be obligated to provide, nor be liable for, any other or additional remedy and PMC’s sole obligation shall be limited to making such repairs and replacements as PMC deems necessary or proper to place the parts or fixtures in good working order and in conformity with the drawings and specifications only. The company will not accept any charge whatsoever that does not have the company’s written approval beforehand. Dimensions and design details are subject to change.

BALLAST GUARANTEE:

Our ballast guarantee is the same as that of the ballast manufacturer. Claims for defective ballasts found to be under warranty are to be made directly to the ballast manufacture. Labor charges for the replacement of defective ballast must be authorized by the ballast manufacturer. PMC Lighting will not incur labor charges for faulty or defective ballasts. This is the responsibility of the ballast manufacturer.

WARRANTY:

All fixtures are guaranteed for a period of one (1) year from date of delivery provided the defect develops under normal and proper use. The guarantee is applicable only to the replacement of a defective fixture or components with positively no labor allowance unless specifically authorized in writing before such work is begun.
